Image Licensing & Usage Rights

All photographs, illustrations, and digital images available on this website are the intellectual property of Eos Koch and are protected by copyright. Below is a description of the Standard License and what it permits and restricts.

Standard License

The Standard License grants you a non-exclusive, non-transferable, worldwide, perpetual license to use the image for most personal and commercial purposes (websites, social media, marketing, editorial use, internal documents, print runs within normal limits). It does not permit resale or redistribution of the image as a standalone file, use as a trademark/logo, or uses where the image is the primary value of a product for resale, for those uses, you need an Extended License or written permission.

1. Grant of Rights

  • License type: Non-exclusive, non-transferable, worldwide, perpetual (unless otherwise stated at time of sale).
  • Rights granted include: reproduce, display, publicly perform, digitally distribute, and create derivative works (e.g., crop, recolor, add text), subject to the restrictions below.
  • No copyright transfer: Copyright remains with Eos Koch. This license only grants usage rights, it does not assign ownership.

2. Permitted Uses examples

The following uses are explicitly permitted under the Standard License unless an individual image page or checkout states otherwise:

  • Web & Digital: website hero images, blog illustrations, landing pages, banners, email marketing, social media posts, app backgrounds (provided the image is not being re-sold).
  • Advertising & Promotion: digital ads, social ads, print advertising (within print run limits listed below).
  • Editorial: news stories, magazine articles, reviews, blogs (including paid editorial publishing).
  • Internal Business Use: internal reports, training materials, internal presentations, slideshows.
  • Print: brochures, flyers, catalogs, books, and magazines where the image is used as part of the design and is not the principal item for resale (see limits below).
  • Inclusion in composite works: design templates, website headers, user interface mockups, provided end-users cannot extract and re-use the original image as a file.

3. Typical Limits & Guidance

  • Print run limit: Standard License typically covers print distributions up to 5000 copies. If you anticipate a larger print run, contact us for an Extended License or custom quote.
  • Digital impressions: Standard License permits ordinary website and social media use without a specific per-impression cap. For very large paid ad campaigns, streaming and broadcast at scale, or when image exposure will be exceptionally large, contact us to confirm whether an Extended License is required.
  • Product resale: Using the image on merchandise or products for sale (e.g., posters, t-shirts, stickers) where the image is a main selling point generally requires an Extended License. If the image is a small, non-prominent design element on a product, a Standard License may be sufficient, contact us if in doubt.
  • Number of end-users: Standard License does not limit how many people can view an image on a website; it does limit redistribution in extractable form.

4. What the Standard License Does Not Permit (key prohibitions)

  • Re-sale or redistribution: You may not resell, sublicense, share, or redistribute the image as a standalone file in any marketplace, stock pack, template library, or otherwise. Bundling the raw image in downloadable resources is prohibited.
  • Logo / trademark use: Use of the image (or a derivative that is essentially the same) as a company trademark, logo, or service mark is not permitted without prior written permission.
  • Primary-value merchandise: Selling physical or digital goods where the image is the primary value (posters, art prints, downloadable image files, or on-demand products where the image is the core feature) requires an Extended License.
  • Machine learning & training: Using the image as part of a dataset to train generative AI/machine learning models is not permitted without explicit written consent.
  • Unlawful or offensive use: Any use that is defamatory, pornographic, illegal, or likely to bring the photographer or subject into disrepute is prohibited.

5. Technical & Practical Rules

  • Derivatives: You are allowed to crop, recolor, overlay text, and make other edits to adapt the image to your creative needs.
  • Extraction: Images may be embedded in documents, PDFs, or products provided recipients cannot extract the file as a standalone image. If you intend to distribute extractable files to third parties, that may require an Extended License.
  • Metadata & credits: Do not remove copyright metadata if present. Attribution is not required but appreciated, a simple “© Eos Koch” is helpful when feasible.

6. Releases & Model/Property Rights

  • Images that include identifiable people or private property may require a model or property release for certain commercial endorsement uses. If a release is available it will be noted on the image’s details page. Standard License does not override the need for releases where required by law.
  • Even with a release, some uses (e.g., settlement claims, endorsements implying endorsement by the depicted person) may be restricted, contact us for clarity on sensitive or high-profile uses.

7. Duration, Territory & Transfer

  • Duration: Unless otherwise stated at purchase, the Standard License is perpetual. You may continue to use already-downloaded images under the license terms.
  • Territory: Worldwide use is permitted.
  • Transfer: The license is personal to the licensee and is not transferable or assignable to third parties, except where an image is incorporated into a larger work (e.g., a book) that is sold, provided the image cannot be extracted as a standalone file.

8. Termination & Breach

  • Any breach of these terms (for example, unauthorized redistribution) automatically terminates the license. Upon termination, you must cease using the image and erase all copies under your control.
  • Termination does not remove liability for actions taken while the license was in effect if those actions violated the license.

9. Indemnity & Liability

While Eos Koch makes reasonable efforts to ensure images are free of third-party claims, the buyer is responsible for verifying their intended use (especially for trademark/endorsement contexts). The full terms of sale and any limitation of liability are available at checkout and on the invoice.

10. How to Request an Extended License or Special Permission

If your intended use exceeds the Standard License (large print runs, merchandise where the image is the principal value, trademark use, dataset and model training, or broadcast at scale), please contact us with the following information:

  • Image information
  • A short description of your intended use
  • Estimated distribution (print run number, expected impressions, territory)
  • Whether the image will appear on merchandise or be resold
